1. About These Terms

These Terms of Service ("Terms") govern your use of sapperwebsites.com, including its pages, content, and forms (the "Site"), and explain how requesting our services works. The Site is operated by Sapper Advanced Technologies LLC, doing business as Sapper Websites ("Sapper," "we," "us," or "our"), 4239 U.S. 23, Piketon, OH 45661, USA.

By using the Site or submitting a form on it, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Site.

2. Our Services

Sapper Websites provides website design and build services for businesses. Information on the Site, including descriptions of services and examples of work, is general information only. It is not a binding offer and does not create any obligation for you or for us.

3. How the Order Process Works

  • Request: When you submit the short form on the Site, you are sending us a request for information or a proposal. Submitting the form does not create a contract and does not obligate you to buy anything or us to provide any services.
  • Agreement: If we decide to move forward with your request, we will send you a written web build agreement by email. That agreement describes the scope of work and the terms that will apply to your project.
  • Acceptance: A contract is formed only when you confirm the agreement by clicking the confirmation link in that email. Until you confirm, neither party is bound.
  • Payment: After you confirm the agreement, we will send you a payment link by email. Payments are processed by a third-party payment processor. We do not receive or store your full payment card number.

Your project is governed by the web build agreement you accept. If these Terms conflict with that agreement, the agreement controls for your project. We may decline any request for any lawful reason.

4. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Site's forms or request our services. If you submit a form on behalf of a business, you confirm that you are authorized to act for that business. Our services are intended for business purposes.

5. Information You Submit

You agree that the information you submit through the Site is accurate and that you have the right to share it. Please do not submit passwords, payment card numbers, Social Security numbers, health information, or other sensitive personal information through our forms or by email. We will never ask you for card details by email. How we handle your information is described in our Privacy Policy.

6. Communications

By submitting a form, you agree that we may contact you by email about your request. You agree that agreements, notices, and other communications we send to you electronically satisfy any legal requirement that they be in writing. We send text messages (SMS) only if you have given separate, express consent to receive them, and you can opt out of text messages at any time by replying STOP.

7. Acceptable Use

You agree not to:

  • use the Site for any unlawful, fraudulent, or harmful purpose;
  • submit false information or impersonate any person or business;
  • send spam, malware, or other harmful code through the Site;

The Site and its content, including text, graphics, logos, the Sapper Websites name, design, and code, are owned by or licensed to Sapper and are protected by intellectual property laws. You may view and print pages for your own personal or internal business use. You may not copy, modify, distribute, or reuse Site content for any other purpose without our written permission. Websites shown as examples of our work and their content belong to their respective owners.

9. Feedback

If you send us suggestions or feedback, we may use them without any obligation to you.

The Site relies on third-party services, such as our hosting provider, form service, analytics provider, and payment processor, and may contain links to third-party websites. We are not responsible for third-party websites or services, their content, or their privacy practices. Your use of them is subject to their own terms and policies.

11. No Guarantee of Results

We do not guarantee any search engine ranking, placement, traffic, leads, sales, or other business results from the Site or from our services. Search engines and other platforms are operated by third parties and change their systems independently of us.

12. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components. Content on the Site is general information and is not legal, tax, or other professional advice.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SAPPER AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100). Liability for services provided under an accepted web build agreement is governed by that agreement. Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

14. Indemnity

You agree to indemnify and hold harmless Sapper and its members, employees, and contractors from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

15. Governing Law and Venue

These Terms and any dispute arising from them or from your use of the Site are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Any such dispute must be brought in the state or federal courts located in the State of Ohio, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. Changes apply from the date they are posted and do not change any web build agreement you have already accepted.

17. General

If any part of these Terms is found unenforceable, the remaining parts stay in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us regarding your use of the Site.
